I posted on Twitter Sunday morning that a whole batch of episodes were finished the filming process and I was heading into the editing portion. I knew it was going to be a long night just to get one episode finished in time for its release today. Sadly I only have limited time to shoot, chop, and post because….you know, life. Long story short, I finished editing the newest episode and was able to get a half an hour of sleep before the kids awoke.
That brings us to today.
I started my day by making a fun little picture for the video, I wrote the description, and added some tags. Sitting back, mildly proud of myself, I hit the button to make the video public. If this was a movie this would be the moment where red siren lights would start to dance across the scene and a buzzer would sound. Heck even a metal barred gate would drop with the appropriate heavy “clank” sound just to nail the point that I was fucked.

What the fuck! As I opened the copyright claim, or more accurately the three claims against me/the video I saw that they were all from one company. I won’t say whom at this time but its a company that I’ve have run-ins with in the past. Surprisingly in those past claims the company via YouTube’s fancy copyright robot, allowed me to still post my videos. This time though the fancy pants robot said “Hell No!” and blocked the whole damn thing.
Well there are two courses of action for me at this moment. One is I need to edit the video again and remove or augment the footage I used. This is a fair action to take but as I said above, I really don’t have any free time until Friday night to edit the video. I might be able to eek a little time one evening but its doubtful…we’ll see. If this is the case than next week I’ll post the video along with a new episode.
The other action I could take is to file a dispute against their claim, which I did. Now honestly it is their right to say I can’t use the footage from cartoons that are more than 30 years old. Knowing this I simply told the truth in my dispute. I said that Chris and I talk about their shows in a loving and nostalgic manner and only wish to add visual representation to our conversation to either help people remember how great these shows were or to education people who hadn’t heard of the shows before. So their claims maybe fair but I also think my use of them under the Fair Use Copyright Disclaimer. The Disclaimer reads…
“Copyright Disclaimer Under Section 107 of the Copyright Act 1976, allowance is made for “fair use” for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is a use permitted by copyright statute that might otherwise be infringing. Non-profit, educational or personal use tips the balance in favor of fair use.”
Anyways, they have 30 days to respond to my dispute. I have a feeling that I will have the episode edited and posted again before I hear back from them. In that case I will just delete the old video, cancel my dispute, and move on a little wiser in the ways of the world.
Either way, if you are a fan of the show I apologize for not having a new episode to share…or do I.
Here is a “Lost Episode” from last year that has never seen the light of day. It’s a little rough around the edges and has zero edits or footage. This was when I hoped being a video version of a podcast was enough. In honesty its the second episode we ever did. Enjoy…hopefully.
Another bit of honesty, I haven’t seen this episode since I originally uploaded it couple months after we recorded it in April of 2017 . I’ll be laughing, crying, and cringing with y’all.
